1. Who and what for

These terms apply between MV3D — sole proprietorship Vincent Montreuil, Nieuwpoortstraat 14, 8570 Anzegem, company number BE 0672.960.066 — and you, as soon as you use the MV3D Converter or take out a subscription.

2. What you get

A right to use the software for as long as your subscription runs. The software remains MV3D’s; you are not buying it, you are using it.

• You may install it on the devices your subscription covers.
• You may use it for your own work and your clients’ work.
• You may not resell, rent or lend it outside your own company.
• You may not attempt to obtain the source code or bypass the protection.

3. Trial period

You can try the software for fourteen days. That period ends by itself: nothing is charged unless you choose it. Whatever you make in those fourteen days stays yours.

4. Price and invoicing

• All prices are exclusive of VAT.
• For companies in the EU outside Belgium VAT is reverse-charged, provided you give a valid VAT number.
• Payments go through Mollie. Invoices are sent by email.
• An invoice is payable within fourteen days of its date.

5. Term and cancellation

A monthly subscription runs from month to month and can be cancelled at any time; it then ends at the close of the month you paid for. A yearly subscription runs for a year. There is no notice period and no penalty — you cancel when you want and use up what you paid for.

6. Availability

The software runs on your own computer and works without internet. The licence checks in periodically to confirm it is still valid; if that fails for a while, the software keeps working. New versions are part of your subscription.

7. Liability

We do everything we can to make a conversion exact, and the software lets you check the result in 3D before it goes to the machine. That check is your responsibility: a file that drives an excavator should be reviewed by a person before the first bucket goes in the ground.

MV3D is not liable for damage resulting from a file put to use without that check, nor for indirect damage such as lost profit or downtime on site. Our liability is in any case limited to the amount you paid for your subscription in the twelve months before the event.

8. Third-party brand names

Trimble, Topcon, Leica, Unicontrol and CHCnav are the property of their respective owners. MV3D is not affiliated with or endorsed by them; their names are used only to indicate which files the software can handle.

9. Governing law

Belgian law applies. Disputes belong before the enterprise court of Ghent, Kortrijk division. But call or write first — most things are settled with one phone call.
